This End-User License Agreement (“EULA”) is a legal agreement between you and AppHero OÜ (“Developer”) for the software product identified above, which includes computer software and may include associated media, printed materials, and “online” or electronic documentation (“Software Product”). By installing, copying, or otherwise using the Software Product, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software Product. The Software Product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software Product is licensed, not sold.
Developer grants to you the non-exclusive, non-transferable, non-sublicensable, limited right and license to install and use one copy of the Software Product on a single computer or device, subject to the terms and conditions of this EULA.
The Software Product is owned by Developer and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. You must not remove or alter any copyright notices on any and all copies of the Software Product.
You may not copy, modify, distribute, sell, or transfer the Software Product or any portion thereof, except as expressly provided in this EULA. You may not reverse engineer, decompile, or disassemble the Software Product, except to the extent that such activity is expressly permitted by applicable law.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from Developer if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the Software Product and destroy all copies of the Software Product in your possession.
The Software Product is provided “AS IS” without warranty of any kind, either express or implied, including without limitation, the implied warranties of merchantability and fitness for a particular purpose. Developer does not warrant that the functions contained in the Software Product will meet your requirements or that the operation of the Software Product will be uninterrupted or error-free.
In no event shall Developer be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) arising out of the use of or inability to use the Software Product, even if Developer has been advised of the possibility of such damages.
This EULA shall be governed by the laws of Estonia without regard to its conflicts of law provisions.
This EULA constitutes the entire agreement between you and Developer and supersede any prior agreements or understandings, whether written or oral, regarding the subject matter of this EULA.
If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
